Unregistered Underground Storage Tanks Barred from Receiving New Deliveries

On January 1, 2009, the District Department of the Environment (DDOE) will institute a delivery prohibition program for underground storage tank facilities that have not been properly registered or are in significant non-compliance with underground storage tank management regulations.

Owners of all underground storage tank systems that store gasoline or diesel fuel and tank systems that store greater than 1,100 gallons of heating oil are required to register their tanks and pay a registration fee by November 30 of each year.  Registration expires on December 31 of the following year. All tank systems that have not been properly registered will be placed on a list of systems for which delivery of new product is prohibited.  Beginning January 6, 2009, this list can be accessed from the District’s Underground Storage Tank Program website.

These tank systems will remain on the list until registration has been properly completed.  Once registration is complete, the facility will receive a registration certificate -- which must be conspicuously posted at the facility.  Delivery companies must ensure that a current registration certification is posted at the facility before product can be delivered.

Also, any tank system that has been found to be in significant non-compliance with the District’s Underground Storage Tank regulations (Title 20, District of Columbia Municipal Regulations, Chapters 55 through 70) will be placed on the delivery prohibition list.  Systems that are in significant non-compliance will also have a tag placed on delivery ports at the facility stating that delivery is prohibited.  Once the system comes into compliance with the appropriate regulations, the facility name will be removed from the delivery prohibition list and the tags will be removed from the delivery ports.
