Proposed Amendments to the 2013 Stormwater Management Regulations and Guidebook

On February 15, 2019, DOEE proposed amendments to the District’s stormwater management regulations and proposed revisions to the District’s Stormwater Management Guidebook (SWMG). DOEE will be receiving public comments for 45 days, through April 1, 2019, at 4:30 PM.

Background 

In the five and a half years since the finalization of the 2013 Rule on Stormwater Management and Soil Erosion and Sediment Control (2013 Stormwater Rule), DOEE has learned from its implementation of the regulations. DOEE has proposed amendments to the regulations to:  

  • Provide compliance flexibility and exemptions for projects that have been disproportionately burdened by compliance, 
  • Improve environmental outcomes through updates to the Stormwater Retention Credit (SRC) program, and 
  • Update review fees and processes. 

DOEE has updated and expanded the SWMG to be consistent with proposed regulatory amendments, as well as, to incorporate technical changes to stormwater Best Management Practice design standards and to clarify existing guidelines and processes. These updates also include changes that DOEE published as Clarifications to 2013 Stormwater Management Rule and Guidebook in 2014 and 2017. 

Comments and Public Hearing 

DOEE invites the public to present information and comments regarding the proposed amendments to the District’s stormwater management regulations and proposed revisions to the SWMG. Comments clearly marked “DOEE Stormwater Management and Soil Erosion and Sediment Control Regulations” or “DOEE Stormwater Management Guidebook”, respectively, may be hand delivered or mailed to the DOEE 1200 First Street NE, 5th Floor. You may also submit comments via by email with the subject line “DOEE Stormwater Management and Soil Erosion and Sediment Control Regulations” or “DOEE Stormwater Management Guidebook” to [email protected] 

DOEE is hosting a public hearing to present on the proposed rulemaking and guidebook revisions Rulemaking, establishing the relief program.
